Waiver Request - Carryover Limitations of FY2020 Title I, Part A Funds and a Request to Extend the Period of Availability of FY2019 Elementary and Secondary Education Act (ESEA) Funding until September 30, 2022
The West Virginia Department of Education is requesting a waiver pursuant to section 8401 of the Elementary and Secondary Education Act of 1965 (ESEA), of the following ESEA requirements:
- ESEA Section 1127(b) of Title I, Part A of the ESEA so that the WVDE may waive, more than once every three years, if necessary, the 15% carryover limitation in ESEA Section 1127(a) for FY2020 Title I, Part A funds.
- ESEA Section 421(b) or the General Education Provisions Act (GEPA) to extend the period of availability of FY2019 funds for program in which the WVDE participates under its approved consolidated State plan until September 30, 2022.
- In seeking this waiver, the WVDE assures that the State's school districts will continue to utilize the funds as intended and in compliance with all program regulations. Due to interruptions caused by the COVID-19 pandemic, it was not possible for schools to complete all planned program activities; this extension and waived carryover limitation will allow schools to complete activities during the 2021-2022 school year.
