According
to the No Child Left Behind Act, any Title I school
that is in its first year of school improvement (two or more consecutive years
not meeting adequate yearly progress) must offer all students enrolled in the
school the option to transfer to another public school within the LEA that has
not been identified for improvement (NCLB Section 1116).
The public schools from which students may choose are not required to be schools
that receive Title I funds. If more than one school is an option for choice,
then the LEA must provide parents a choice of more than one school.
