The Every Student Succeeds Act (ESSA) limits the number of students that a state may assess using an alternate assessment to no more than 1.0 percent of all students in the grades assessed in each subject area. The WVDE has previously been granted a waiver for the participation rate and is requesting an extension for SY2022-23. West Virginia anticipates exceeding the 1.0 percent cap in ELA (1.16%), Math (1.16%), and Science (1.24%). The West Virginia 1.0 Percent State-Level Cap Waiver Extension Request is being submitted for stakeholder review.
