To receive IDEA funding, OSEP requires states to publish the proposed plan at least 60 days prior to the date on which the plan is submitted, with an opportunity for public comment on the plan to be accepted for at least 30 days, in accordance with the Education Department General Administrative Regulations (EDGAR), 34 CFR §76.102.  WVDE must meet specific public participation requirements including public hearings, ensure adequate notice of the hearings and provide an opportunity for the general public to comment on the application (34 CFR §300.165).   To address Section IV of the application, State Administration, the required list of rules, regulations or policies that are state-imposed is attached.
