Dear Dr. Canonico:

You have asked, where three elementary schools (Franklin, Upper Tract and Seneca Rocks) will be closed, and the students in grades K-8 will be removed from Circleville School, and the students in grades 7 & 8 will be removed from Franklin High School:

1. "For the schools we are closing[,] must the hearings be held at the schools in question, or can the hearing[s] be at a neutral site?"

The hearings can be held at a neutral site convenient to the public; the hearings do not have to be held at the respective schools. In this respect, please read my enclosed letter of April 23, 1990(13), to Stephen L. Baldwin and my letter of October 8, 1991(20), to Carolyn Meadows, which are enclosed.

2. "Can we have one hearing for the three schools on the same evening, or must each school have a separate hearing on three different days?"

Each school is entitled to a hearing, but the hearings can be held one after another on the same day. Please refer to the aforementioned letters, especially in regard to notice of meeting times.

3. "Do we need a hearing on the moving of students from Circleville and Franklin High School if the buildings will not be closed."

Hearings will be necessary if the students are moved to a school which they would not normally have been promoted to. Hearings will not be necessary if the students are moved to a school which they normally would have been promoted to. Please refer to the enclosed Op. Att'y Gen., February 24, 1986. Therefore, a hearing probably will be necessary for the seventh and eighth grade students of Franklin High School, and a hearing probably will not be necessary for at least some of the K-8 students of Circleville School.
