RE: Right to Privacy Act and Freedom of Information Act
Dear Mr. Adams:
You have asked whether a copy of the certified list may be provided to anyone upon request. You are especially concerned about revelation of salaries and social security numbers; however, you would like to know how much information can be deleted from the copy given out as public information upon request. The names of school personnel and their respective salaries must be given to any resident of the county upon request, according to W. Va. Code 18-9-3a (last paragraph). The Social Security Number is a commonly used identifier; however, it should not be revealed as public information unless the employee requests (preferably in writing) that it be revealed. Any information on the certified list, except for employees' names and their salaries, can be deleted from the certified list before it is released to a county resident if the county board of education thinks that it has a good reason for denying release of the information. Please refer to W. Va. Code 29B-1-3.*
