Enclosed you will find copies of West Virginia Code ?? 18A-4-7a and 18A-4-7b and a decision from the West Virginia Education and State Employees Grievance Board titled Esther Blair v. Mingo County Board of Education, Docket No. 94-29-1083, which you may find useful. Neither Code ? 18A-4-7b nor the Blair case are directly on point, however, I believe they will help clarify your situation. As I explained, the West Virginia Department of Education does not become involved in personnel grievances or hiring decisions made at the county level.
