Dear Ms. Carter:
On January 16, 2001, you called our legal services department for information on
statutes, policies, or cases regarding the accrual of seniority for substitute teachers.
Enclosed you will find copies of West Virginia Code ?? 18A-4-7a and 18A-4-7b and a
decision from the West Virginia Education and State Employees Grievance Board titled
Esther Blair v. Mingo County Board of Education, Docket No. 94-29-1083, which you may
find useful. Neither Code ? 18A-4-7b nor the Blair case are directly on point, however, I
believe they will help clarify your situation. As I explained, the West Virginia Department
of Education does not become involved in personnel grievances or hiring decisions made at the county level.
