State Law and Charter Schools

West Virginia does not currently have a charter law. However, the West Virginia Department of Education understands the importance of providing schools with the autonomy needed to solve educational problems and increase student achievement. To help achieve this goal, the West Virginia Legislature passed a bill in June 2009 (H.B. 109) authorizing school innovation zones. Innovation zones enable LEAs to operate innovative, autonomous public schools with flexibilities in structures similar to charter schools. W. Va. Code §18-5B-1 through §18-5B-9 describes the provisions of the School Innovation Zones Act

WVBE Policy 3236 was written in collaboration with practicing educators, state teacher organization representatives, as well as business and community representatives to provide guidelines for implementation of education InnovationZones to improve educational performance in a manner that provides greater flexibility from policy and law for principals and teachers to meet the needs of a diverse population of students.  This WVBE policy will create the opportunity for information regarding the effects of specific innovative educational strategies on student achievement; and to provide more public school accountability for student achievement as measured by the state assessment programs and local assessment processes identified by the schools.
