WEST VIRGINIA BOARD OF EDUCATION

I. Call to Order


  President Priscilla M. Haden called the meeting of the West Virginia Board of Education (WVBE) to order at 9:00 a.m. on November 10, 2009, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.


The following members were present:  President Haden, Vice President Jenny N. Phillips, Secretary Robert W. Dunlevy, Delores W. Cook, Michael I. Green, Lowell E. Johnson, L. Wade Linger Jr., and Gayle C. Manchin, and ex officio Steven L. Paine, State Superintendent of Schools.  Student representative in attendance was Ben Adams of Charleston who attends Capital High School.  Members absent were:  Burma Hatfield, and ex officios  Brian E. Noland, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.  


II. Approval of Agenda


Upon motion by Mrs. Cook, seconded by Ms. Phillips, the Board unanimously approved the agenda. 


III. Consent Agenda


Upon motion by Mr. Dunlevy, seconded by Ms. Phillips, the Board unanimously approved the Consent Agenda.  (Copies appended to Official Minutes, Attachments A through M.)


Meeting minutes of October 7 and 8, 2009  (Attachment A)


Amendment to the Mid-Ohio Valley Technical Institute Comprehensive Educational Facilities Plan to include the removal of a classroom wall to add lab and instructional space, the addition of movable walls to further divide three other program areas to create additional instruction space, replacement of ceiling tile in the main lobby, and replacement of floor coverings in the IMC, business classroom, health occupations classroom, and the main office (Attachment B)


Amendment to the Calhoun-Gilmer Career Center Comprehensive Educational Facilities Plan to include electrical upgrades encompassing branch circuits, electrical repair in the academic lab, installation of a fire alarm system, a HVAC system for the Environmental Technology Lab, and wiring to enable our facility to meet National Electrical Code (Attachment C)


Amendment to the Doddridge County Comprehensive Educational Facilities Plan to include the renovation of the HVAC system at Doddridge County Middle School (Attachment D)


Amendment to the Hampshire County Comprehensive Educational Facilities Plan to include an upgrade to the air conditioning system at Capon Bridge Elementary (Attachment E)


Amendment to the Jefferson County Comprehensive Educational Facilities Plan to include replacement of windows at Ranson Elementary School and Shepherdstown Elementary School, the construction of an addition at Harpers Ferry Middle School, and HVAC upgrades at Shepherdstown Elementary School and C. W. Shipley Elementary School  (Attachment F)


Amendment to the Lewis County Comprehensive Educational Facilities Plan to include renovations and the addition of classrooms, preschool playground, and bus loop to the main school facility at Jane Lew Elementary School and the addition of an outdoor classroom and restroom facility at Peterson‑Central Elementary School  (Attachment G)


Amendment to the Wayne County Comprehensive Educational Facilities Plan to construction of a new pre-K through eighth grade school for Fort Gay Elementary and Fort Gay Middle Schools and the construction of new auxiliary gymnasiums at Tolsia High School and Wayne High School include   (Attachment H)


Amendment to the Wood County Comprehensive Educational Facilities Plan to include the projects listed in the Attachment I  (Attachment I)


Amendment to the Wyoming County Comprehensive Educational Facilities Plan to include the construction of a new Pineville Elementary School  (Attachment J)


One request for a partial waiver of attendance at the 2009-2010 West Virginia Principal’s Leadership Academy for New Principals  (Attachment K)


Employment of Substitute Teachers in Areas of Critical Need policies for Hampshire, Hardy, and Lewis County Schools  (Attachment L)


Notifications, per Senate Bill 227, W. Va. Code §18A-4-7a, Transfer of Teachers After Five Days Prior to Starting Instruction, from Hampshire, Kanawha, Lewis, McDowell, Wetzel, Wirt, and Wood County Schools (Attachment M)


IV. Reports


Board Member/Committee Reports.  

  Mr. Adams addressed the Board regarding his service as the student representative to the Board in the coming months and also provided his thoughts as to alternative routes to certification and how to attract individuals to the teaching profession.  Mr. Adams will serve during the months of November, December, and January.

  President Haden (distributed information) reported the following:  attended the National Association of State Boards of Education (NASBE) annual conference, Innovation Zone informational meeting, counselors’ conference, RESA 8 regional meeting, Governor’s Education Summit, Professional Development Committee Meeting (Superintendent Paine is to convene a Professional Development Stakeholder Council ~ Mrs. Cook will serve as the Board’s representative on the council), attended a Department meeting regarding Local School Improvement Councils (LSICs), and attended a recognition ceremony (Teaching American History Experience in West Virginia) at the Culture Center. 

■ Mrs. Cook thanked everyone for their consideration during the past few months while she tended to her husband who is recovering from injuries sustained in an accident. 

■ Mrs. Manchin reported the following:  attended NASBE annual conference, GEAR-UP meeting, 21st Century Jobs Cabinet meeting (the next meeting will take place December 7), Governor’s Education Summit, and participated in the Lights On After School Program.

■ Mr. Dunlevy reported the following:  attended RESA 6 meeting, participated in West Virginia Secondary School Activities Commission hearings, and visited School Building Authority of West Virginia sites.

  Ms. Phillips attended a RESA 4 regional council meeting.

■ Dr. Johnson (distributed information) reported the following:  attended NASBE conference and reported on numerous tasks completed as a result of his election as President of NASBE (a regional meeting for state board members in the Southern States will take place January 11-12 for the primary purpose of learning about and reacting to the proposals regarding Common Core Standards; Board members are to notify President Haden if they are interested in attending), attended Professional Development Committee meeting, 21st Century Jobs Cabinet meeting, Governor’s Education Summit, Parental Involvement Advisory Council meeting, Learning First Affiliates meeting, provided an update (assisted by Ms. Donna Peduto, Coordinator, WVDE Office of Organizational Effectiveness and Leadership) regarding the Innovation Zone initiative, and provided an update (assisted by Mr. Chuck Nichols, Executive Director, RESA 3 and RESA liaison to the Board) regarding the work of the Board’s RESA Committee in the area of communications.  Dr. Johnson requested that the Department review state code as to required committees and to provide consolidation options for the Board’s consideration at the December meeting. 

■ Mr. Linger (distributed information) reported the following:  attended a Department meeting regarding LSICs and an invitational forum for state leaders regarding the future of instructional materials selection.  (Copies appended to Official Minutes, Attachment R.)

President Haden called for a break at 10:46 a.m.

President Haden called the meeting back to order at 11:07 a.m.


VII. Reports (Continued)


State Superintendent’s Report.  Superintendent Paine presented Department personnel items for the Board’s information and stated that there was no new information to share with regard to Grant, McDowell, Mingo, and Preston Counties.  Superintendent Paine reported that he traveled to Monroe County to announce West Virginia’s 2010 Milken Award recipient, Ms. April Hobson, English teacher at James Monroe High School.  (Copy appended to Official Minutes, Attachment Mc.)


Update - Race to the Top Grant Application Process.  Superintendent Paine provided an update (assisted by Dr. Amelia Courts, Executive Director, Office of ESL – International Schools) regarding the Race to the Top Grant application process and West Virginia’s proposal.  (Copy appended to Official Minutes, Attachment N.)


2009 NAEP Results for Mathematics (Grades 4 and 8).  Superintendent Paine provided an update (assisted by Dr. Jan Barth (distributed information), Executive Director/Special Assignment, and Mr. Larry White, Psychometrician/Lead Research, WVDE Office of Assessment, Accountability and Research) regarding the 2009 NAEP results for mathematics in grades four and eight.  (Copy appended to Official Minutes, Attachment S.)  


VIII. Update of WVBE Statutory Units/Liaisons/Presidential 

Committees 2009-2010


President Haden presented an amended listing of Board Committee appointments for 2009-2010 for the Board’s consideration.  Mrs. Manchin addressed the Board regarding the NASBE component to the Board’s Wellness Committee and her service as liaison to NASBE with regard to wellness issues.  


Upon motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the appointments listing as amended.  (Copy appended to Official Minutes, Attachment O.) 


IX. WVBE Personnel Matters Including the

Termination of Employment of an Employee at RESA 7


Dr. Jack McClanahan, Deputy State Superintendent of Schools, distributed an addendum to the Board’s personnel items for the Board’s consideration.


Upon motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the Board’s personnel items, as amended, including the termination of employment of an employee at RESA 7.  (Copy appended to Official Minutes, Attachment P and addendum.)


X. Future Meetings

The next regular meeting of the Board will be held December 9-10, 2009, in Charleston, West Virginia.  President Haden announced the following meetings:  1) December 9 Board meeting will begin at 10 a.m.; 2) interviews for the Executive Director of RESA 4 will take place on December 11 beginning at 9 a.m.; 3) appointed Mr. Green as co-chair of the Board’s Technology Committee and encouraged the committee to meet; 4) High School Redesign Committee to meet December 17; and, 5) Mrs. Cook stated that the Board’s Legislative Committee will meet prior to the December Board meeting.  


XI. Board Items for Future Consideration


President Haden requested that items mentioned during the meeting and any others that members wish to be considered for placement on a future agenda be provided to her or Dr. Jack McClanahan, Deputy State Superintendent of Schools, as soon as possible.  (Copy appended to Official Minutes, Attachment Q.) 


XII. Adjournment


President Haden declared the meeting adjourned at 12:25 p.m.
