WEST VIRGINIA BOARD OF EDUCATION

I. Call to Order


  President Delores W. Cook called the meeting of the West Virginia Board of Education (WVBE) to order at 12:30 p.m. on July 8, 2009, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.


The following members were present:  President Cook, Vice President Priscilla M. Haden, Secretary Jenny N. Phillips, Robert W. Dunlevy, Burma Hatfield, Lowell E. Johnson, L. Wade Linger Jr., and Gayle C. Manchin, and ex officio Steven L. Paine, State Superintendent of Schools.  Members absent were Barbara N. Fish and ex officios Brian E. Noland, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.


II. Delegation


Mr. Cameron Wilson, resident of Roane County, student at West Virginia University, and current summer intern in the WVDE Office of Child Nutrition, addressed the Board regarding his accomplishments since serving as student representative to the Board in 2007.


III. Approval of Agenda


Upon motion by Ms. Phillips, seconded by Mr. Dunlevy, the Board unanimously approved the agenda. 


IV. Initial Education Performance Audit Report

for the Board of Child Care (Juvenile Institutional Education Program)

Located in Berkeley County


Dr. Kenna R. Seal, Director, Office of Education Performance Audits (OEPA), reported that an announced on-site review of the Board of Child Care (Juvenile Institutional Education Program) which is under the governance of the WVBE and State Superintendent of Schools was conducted on May 28, 2009.  The review was conducted at the specific direction of the WVBE and to assure effective and efficient education programs and accountability to the public for the education of students in juvenile institutions.


Upon recommendation of Dr. Seal and a motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the report.  (Copy appended to Official Minutes, Attachment A.)


V. Initial Education Performance Audit Report

for the Beckley Center (Juvenile Institutional Education Program)

Located in Raleigh County

Dr. Seal reported that an announced on-site review of the Beckley Center (Juvenile Institutional Education Program) which is under the governance of the WVBE and State Superintendent of Schools was conducted on May 14, 2009.  The review was conducted at the specific direction of the WVBE and to assure effective and efficient education programs and accountability to the public for the education of students in juvenile institutions.


Upon recommendation of Dr. Seal and a motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the report.   (Copy appended to Official Minutes, Attachment B.)


VI. West Virginia Secondary School Activities Commission

Series 2, Athletics, Provisions Governing Eligibility, and

Series 3, Provisions Governing Contests


Mr. Gary Ray, Executive Director, WVSSAC, presented proposed rule changes for the Board’s consideration.  


Following discussion, Mr. Dunlevy moved, and Dr. Johnson seconded, that proposals one, two, three, four, and six, be approved, and that proposals five and seven not be approved.  Upon the call for the question the motion was carried unanimously.  (Copy appended to the Official Minutes, Attachment C.)


VII. Presentation on New Public Website with

    County Demographic and Assessment Data


Superintendent Paine, assisted by Dr. Jack McClanahan, Deputy Superintendent of Schools, demonstrated a public website (currently under construction) that will contain demographic and assessment information.  


VIII. Policy 2340, West Virginia Measures of Academic Progress


Dr. Jan Barth, Executive Director, WVDE Office of Assessment and Accountability, presented Policy 2340 for the Board’s consideration.  (Copy appended to the Official Minutes of July 9, 2009 at Attachment I.)


IX. Policy 2445.41 "Textbooks" Adoption: Notice,

Request and Instructions to Publishers


Ms. Carla Williamson, Executive Director, WVDE Office of Instruction, presented Policy 2445.41 for the Board’s consideration.  Following discussion, Dr. Johnson requested that textbook code be reviewed, and amended as necessary, for submission during the next legislative session, and Ms. Haden requested that the waiver process be reviewed and that future waiver requests include supporting data.  (Copy appended to the Official Minutes of July 9, 2009 at Attachment J.)

X. Child and Adult Care Food Program (CACFP)


Ms. Mollie Wood, Assistant Director, WVDE Office of Child Nutrition, provided an overview of the Child and Adult Care Food Program CACFP.  The CACFP provides funding for nutritious meals to children in child care centers, HeadStart programs, outside school hours programs, adult day care facilities, domestic violence shelters, homeless shelters and family day care home settings.

President Cook called for a break at 1:45 p.m.

President Cook called the meeting back to order at 2:00 p.m.


XIII. Amendment to the Agenda

State Superintendent’s Report


Superintendent Paine questioned Staff Attorney Sherri Goodman, regarding amending the agenda by moving an item from the July 9 agenda to the July 8 agenda.  Ms. Goodman advised that such an amendment would be acceptable as long as no action was taken.  Thereupon the Board, by consensus, amended the July 8 and 9 agendas and took up the Legislative Update portion of the Superintendent’s Report as noticed on the July 9 agenda.  Superintendent Paine, with the assistance of Dr. Karen Huffman, Special Assistant to the State Superintendent, Division of Educator Quality and System Support, provided information regarding a master calendar for educators; discussed a number of emerging educator issues; provided an update regarding House Bill 3340 (assisted by Dr. McClanahan), Senate Bill 1001 (assisted by Dr. Jorea Marple, Assistant State Superintendent, Division of Curriculum and Instructional Services), House Bill 109 (assisted by Dr. Huffman/distributed information),  Senate Bill 106 (assisted by Mr. Joe Panetta, Executive Director, WVDE Office of School Finance), and the recently released federal broadband rules.  Dr. McClanahan requested that Board members be appointed to Department committees to assist with the development policy as required by Senate Bill 1001 and House Bill 109.  (Copy appended to Official Minutes, Attachment D.)  


XIV. Legal and/or Personnel Matters


As the presiding officer, President Cook informed the members that she had identified various matters that required discussion in Executive Session involving attorney-client privilege, citing W.Va. Code '6-9A-3, and personnel, citing W.Va. Code '6-9A-4(b)(2)(A).


Upon motion by Mrs. Manchin, seconded by Ms. Phillips and unanimously carried, the Board entered into Executive Session at 3:32 p.m.


XV. Return from Executive Session


The Board returned from Executive Session at 4:06 p.m. at which time President Cook announced that no action was taken and no decisions were made.

XVI. Future Meetings

The next regular meeting of the Board will be held July 9, 2009 in Charleston, West Virginia.  


XVII. Adjournment


Upon motion by Ms. Phillips, seconded by Mrs. Manchin and unanimously carried, the Board adjourned at 4:07 p.m.
