WEST VIRGINIA BOARD OF EDUCATION

I. Call to Order


  President Delores W. Cook called the meeting of the West Virginia Board of Education (WVBE) to order at 12:35 p.m. on May 13, 2009, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.


The following members were present:  President Cook, Vice President Priscilla M. Haden, Secretary Jenny N. Phillips, Robert W. Dunlevy, Barbara N. Fish, Lowell E. Johnson, and L. Wade Linger Jr., and ex officios Steven L. Paine, State Superintendent of Schools, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.  Members absent were Burma Hatfield and Gayle C. Manchin, and ex officio Brian E. Noland, Chancellor, West Virginia Higher Education Policy Commission.  Also absent was student representative Vincent J. Tennant.


II. Approval of Agenda


Upon motion by Mr. Dunlevy, seconded by Ms. Phillips, the Board unanimously approved the agenda. 


III. Education Performance Audit Report for the

Lincoln County School District and Lincoln County High School


Dr. Kenna R. Seal, Director, Office of Education Performance Audits (OEPA), reported that an announced on-site review was conducted at the Lincoln County School District on March 30 - April 2, 2009, and at Lincoln County High School on March 31, 2009.  The OEPA conducted the review to determine progress of the county in meeting the conditions for return or partial return of local control.


Upon motion by Mrs. Fish, seconded by Dr. Johnson, the Board unanimously returned provisional control, as outlined in the Memorandum of Understanding (attached), pending approval and signing of the Memorandum by all Lincoln County Board of Education members. 

Upon motion by Ms. Haden, seconded by Mr. Dunlevy, the Board unanimously granted Conditional Approval status to the Lincoln County School District and directed that Lincoln County High School and Lincoln County review the school’s Five-Year Strategic Plan within 30 days and correct the findings noted in the report by the next accreditation cycle.  (Copy appended to Official Minutes, Attachment A and addendum.)

  

IV. Initial Individual School Education Performance

Audit Reports for Back Creek Valley Elementary School,

Bedington Elementary School, Gerrardstown Elementary School,

Hedgesville Elementary School, Marlowe Elementary School,

Orchard View Intermediate School, and

Mountain Ridge Intermediate School, Berkeley County


Dr. Seal reported that announced on-site reviews were conducted at Back Creek Valley Elementary School (March 26, 2009), Bedington Elementary School (March 26, 2009), Gerrardstown Elementary School (March 25, 2009), Hedgesville Elementary School (March 24, 2009), Marlowe Elementary School, (March 25, 2009), Orchard View Intermediate School (March 24, 2009), and Mountain Ridge Intermediate School (March 26, 2009).


Upon recommendation of Dr. Seal and a motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the reports for Back Creek Valley Elementary School, Bedington Elementary School, and Gerrardstown Elementary School, and directed that Hedgesville Elementary School, Marlowe Elementary School, Orchard View Intermediate School, and Mountain Ridge Intermediate School revise their schools’ Five‑Year Strategic Plans within 30 days and correct any findings noted in the reports by the next accreditation cycle.  (Copy appended to Official Minutes, Attachment B.)


V. Initial Individual School Education Performance

Audit Reports for Mason-Dixon Elementary School and

University High School, Monongalia County


Dr. Seal reported that announced on-site reviews were conducted at Mason-Dixon Elementary School and University High School on March 10, 2009.


Upon recommendation of Dr. Seal and a motion by Mr. Dunlevy, seconded by Ms. Phillips, the Board unanimously directed that Mason-Dixon Elementary School and University High School revise their schools’ Five-Year Strategic Plans within 30 days and correct any findings noted in the report by the next accreditation cycle.   (Copy appended to Official Minutes, Attachment C.)  


VI. Break


President Cook called for a break at 1:58 p.m.  


VII. Call to Order


President Cook called the meeting back to order at 2:10 p.m.



VIII. West Virginia Secondary School Activities Commission (WVSSAC)

Series 2 and 3


Mr. Gary Ray, Executive Director, WVSSAC, presented proposed rule changes for the Board’s consideration.  (Copy appended to the Official Minutes of May 14, 2009 at Attachment G-1 and G-2.)


IX. Policy 2520.35, 21st Century Science 9-12 Content Standards

and Objectives for West Virginia


Ms. Marty Burke, Assistant Director, and Ms. Robin Anglin, Coordinator, WVDE Office of Instruction, presented Policy 2520.35 for the Board’s consideration.  (Copy appended to Official Minutes, Attachment D and to the Official Minutes of May 14, 2009 at Attachment H.)


X. WESTEST 2 Cut Scores


Dr. Jan Barth, Executive Director, WVDE Office of Assessment and Accountability, presented WESTEST 2 cut scores for the calculation of Adequate Yearly Progress (AYP) for school year 2008-09 for the Board’s consideration.  (Copy appended to the Official Minutes of May 14, 2009 at Attachment I.)


XI. Legal and/or Personnel Matters


As the presiding officer, President Cook informed members that she had identified various matters that needed to be discussed in Executive Session involving attorney-client privilege, citing W. Va. Code '6-9A-3, and personnel, citing W. Va. Code '6-9A-4(b)(2)(A).


Upon motion by Dr. Johnson, seconded by Mrs. Fish, and unanimously carried, the Board entered into Executive Session at 2:50 p.m.


XII. Return from Executive Session


The Board returned from Executive Session at 4:11 p.m. at which time President Cook announced that no action was taken and no decisions were made.



XIII. Future Meetings

The next regular meeting of the Board will be held May 14, 2009 in Charleston, West Virginia.  


XIV. Adjournment


Upon motion by Dr. Johnson, seconded by Ms. Haden and unanimously carried, the Board adjourned at 4:20 p.m.
