I. Call to Order


  President Delores W. Cook called the meeting of the West Virginia Board of Education (WVBE) to order at 9:00 a.m. on April 9, 2009, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.


The following members were present:  President Cook, Vice President Priscilla M. Haden, Secretary Jenny N. Phillips, Robert W. Dunlevy, Barbara N. Fish, Burma Hatfield, Lowell E. Johnson, L. Wade Linger Jr., and Gayle C. Manchin, and ex officio Steven L. Paine, State Superintendent of Schools.  Student representative in attendance was Vincent Tennant of Wheeling who attends Linsly School.  Members absent were Brian E. Noland, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.  


II. Recognition


The Board recognized Mr. Mark Moore, Coordinator, Employee Development Center, WVDE Office of Instructional Technology, for being named 2008 Thinkfinity Trainer of the Year.


III. Approval of Agenda


Upon motion by Ms. Phillips, seconded by Mrs. Fish, the Board unanimously approved the agenda. 


IV. Consent Agenda


Upon motion by Mr. Dunlevy, seconded by Ms. Phillips, the Board unanimously approved the Consent Agenda.  (Copies appended to Official Minutes, Attachments A through L.)


Meeting minutes of March 10, 2009  (Attachment A)


Budget supplement and transfer requests for the month of March 2009 as follows:  total supplements = $25,884,168 and total transfers = $31,463,303 (Attachment B)


One waiver request of attendance at the West Virginia Principal Leadership Academy for New Principals  (Attachment C)


Two requests for new waivers of WVBE policy, three requests for new waivers of instructional materials, and one request for a continuation waiver of instructional materials  (Attachment D)


Twenty-eight county applications representing summer school at 61 county locations  (Attachment E)


Notifications, per Senate Bill 227, W. Va. Code §18A-4-7a, Transfer of Teachers After Five Days Prior to Starting Instruction, from Fayette and Nicholas County Schools  (Attachment F)

Policy 2325, High Quality Standards for Juvenile Institutional Education Programs (Attachment I)

V. Reports


Board Member/Committee Reports.  Mrs. Manchin, Dr. Johnson, Ms. Haden (distributed information), Mrs. Fish (distributed information), Ms. Phillips, President Cook, and Mr. Dunlevy provided information regarding their participation in a number of meetings and events.  (Copy appended to Official Minutes, Attachment P.)


State Superintendent’s Report.  Superintendent Paine presented Department personnel actions for the Board’s information and provided updates in Lincoln, McDowell, Mingo, Preston and Gilmer Counties.  Superintendent Paine also discussed the Technology Counts Report, National Commission on Teaching and America’s Future 2008 data, and distributed a “working draft” copy of a document entitled “West Virginia Guidebook – For the Use of American Recovery and Reinvestment Act ARRA Funds.”

President Cook called the meeting back to order at 10:47 a.m.


VIII. Reports (Continued)


State Superintendent’s Report (Continued).  Superintendent Paine’s report continued with discussion of teacher retirement statistics and the ARRA document.  Dr. Johnson requested an item be placed on a future agenda regarding international benchmarking.  Superintendent Paine requested that Board’s approval, and it was granted, to convene a stakeholder group to review H. B. 4669 schools and community involvement.  Upon motion by Mrs. Manchin, seconded by Ms. Haden, the Board unanimously accepted the Superintendent’s report.  (Copy appended to Official Minutes, Attachment M and addendum.)  


Legislative Update.  Dr. Jack McClanahan (distributed information), Deputy State Superintendent of Schools, provided an update regarding legislative initiatives.  (Copy appended to Official Minutes, Attachment Q.)


Live It Up!  The WVDE Worksite Wellness Committee.  Dr. Pamela S. Cain (distributed information), Assistant State Superintendent, Division of Student Support Services, and Ms. Gus Nelson, Coordinator, WVDE Office of Child Nutrition, provided information regarding the WVDE’s worksite wellness campaign entitled Live It Up!  The campaign relies on leadership from a cross-section of staff and utilizes research-based programs that encourage employees to make healthy lifestyle choices.  (Copy appended to Official Minutes, Attachment Mc and addendum.)  


Regional Education Service Agency (RESA) Report.  Mr. Nick Zervos (distributed information), Executive Director, RESA 6, assisted by Ms. Kim McConnaughy, Coordinator of Adult Basic Education, Ms. Marian Kajfez, Director of Programs, and Mr. Greg Minnich, Director of Finance, provided an update regarding RESA 6 activities and initiatives.  (Copy appended to Official Minutes, Attachment R.)


West Virginia School Boards Association (WVSBA) Update.  Dr. Howard M. O’Cull, Executive Director, WVSBA, provided an update regarding local board issues and concerns including county board interventions, pre-service the position of county board superintendent, training for school board members, and sharing of central office administrative services among counties.  President Cook requested Dr. O’Cull meet with Superintendent Paine and that the results of the meeting be shared with the Board at its May meeting.  Mrs. Fish suggested that Dr. O’Cull attend the next meeting of the leadership collaborative.

IX. WVBE Personnel Matters 


Upon motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the Board’s personnel items as presented in the attachment.  (Copy appended to Official Minutes, Attachment N.)

X. Board Items for Future Consideration


President Cook requested that items mentioned during the meeting and any others that members wish to be considered for placement on a future agenda be provided to her or to Dr. Jack McClanahan, Deputy State Superintendent of Schools, as soon as possible.  President Cook also requested the Board’s direction regarding the June meeting dates as a number of Board members must travel to National Association of State Boards of Education committee meetings scheduled for June 12 and 13.  It was the consensus of the Board that the June meeting be moved to June 9 and 10.  President Cook provided information regarding the Arts Alive celebration.  (Copy appended to Official Minutes, Attachment O.)


XI. Future Meetings

The next regular meeting of the Board will be held May 13-14, 2009 in Charleston, West Virginia.  The Board will meet with RESA Executive Directors on May 13.  


XII. Adjournment


Upon motion by Dr. Johnson, seconded by Ms. Haden and unanimously carried, the Board adjourned at 12:55 p.m.
