I. Call to Order


  President Delores W. Cook called the meeting of the West Virginia Board of Education (WVBE) to order at 9:00 a.m. on January 15, 2009, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.


The following members were present:  President Cook, Vice President Priscilla M. Haden, Secretary Jenny N. Phillips, Robert W. Dunlevy, Barbara N. Fish, Lowell E. Johnson, L. Wade Linger Jr., and Gayle C. Manchin, and ex officios Steven L. Paine, State Superintendent of Schools, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.  Members absent were Burma Hatfield, ex officio Brian E. Noland, Chancellor, West Virginia Higher Education Policy Commission, and student representative Lindsay Holmes, Sissonville High School (Kanawha County).


II. Approval of Agenda


President Cook requested that items (Data Report on KIDS FIRST Initiative for Kindergarten Students, Coordinated School Health Programs, and Position Statement on Coordinated School Health), deferred from the January 14 agenda be added to the January 15 agenda.  Upon motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the agenda as amended. 


III. The J. R. Clifford Project


Dr. Karen K. Larry, Executive Assistant, State Superintendent’s Office, introduced Katherine L. Dooley (distributed information), Esq., Dooley Law Firm, P.L.L.C.  Attorney Dooley provided an overview of the J. R. Clifford Project.  The goal of the project is to help reclaim and expand the history of J.R. Clifford and his resistance to oppression. The central message of the Clifford story is found in a civil rights case presented to the West Virginia Supreme Court in the 1896, Carrie Williams vs. The Tucker County Board of Education.  It was the consensus of the Board that a letter be issued in support of the J. IV. SAS® Curriculum Resources for West Virginia Students


Ms. Brenda Williams (distributed information), Executive Director, WVDE Office of Instructional Technology, introduced Mr. Bruce Friend, Director, SAS® Curriculum Pathways®.  Ms. Williams and Mr. Friend provided information regarding SAS® curriculum resources available to West Virginia educators and students.  (Copy appended to Official Minutes, Attachment P.) 


V. Delegations


Mr. Dale Lee, President, West Virginia Education Association, addressed the Board regarding concerns of WVEA members regarding lesson plans and paperwork.


VI. Consent Agenda


Upon motion by Dr. Johnson, seconded by Mr. Dunlevy, the Board unanimously approved the Consent Agenda.  (Copies appended to Official Minutes, Attachments B through L.)


Meeting minutes of December 9, 10 and 11, 2008  (Attachment B)


Budget supplement and transfer requests for the month of December 2008 as follows:  total supplements = $23,613,820 and total transfers = $20,623,628 (Attachment C)


Amendment to the McDowell County Comprehensive Educational Facilities Plan to include approval of the McDowell County's CEFP update (Attachment D)


Amendment to the Wirt County Comprehensive Educational Facilities Plan to include construction of restrooms near the gymnasium  (Attachment E)


Five applications for a total of 1,450 applications for Operation Recognition in connection with Policy 4355:  High School Diplomas for Veterans  (Attachment F)


One new request and one continuation request for waiver of instructional materials.  One request for a new waiver of WVBE policy was denied  (Attachment G)


Notifications, per Senate Bill 227, W. Va. Code §18A-4-7a, Transfer of Teachers After Five Days Prior to Starting Instruction, from Hampshire and Wood County Schools  (Attachment H)


Employment of Substitute Teachers in Areas of Critical Need policies for Kanawha and Mercer County Schools  (Attachment I)


Received the Medicaid Reimbursement to Districts Annual Report FY 08 (Attachment J)


Issued Moundsville Middle School Temporary Accreditation status with an April 30, 2009 Date Certain to correct the remaining findings  (Attachment K)


Hardy County School System Plan to Eliminate a Casual Deficit (Attachment L).

IX. Data Report on KIDS FIRST Initiative for Kindergarten Students


Ms. Melanie B. Purkey (distributed information), Executive Director, and Ms. Rebecca King, Coordinator, WVDE Office of Healthy Schools, provided first year data regarding implementation of the KIDS FIRST initiative for kindergarten students.  The KIDS FIRST initiative encourages all kindergarten students to receive a HealthCheck (Comprehensive Screening/Wellness Exam) prior to enrollment into kindergarten beginning the 2008-09 school year.  The KIDS FIRST screening includes vision, hearing, speech, language, and growth and development.  The collected data pertains to aggregate information for the following:  BMI; screening source (Health Care Provider (HCP) on school site, HCP prior to enrollment, School Screen or Collaborative); and the actions taken by the school as follow-up to the HealthCheck information.  The data will enable the state level collaborative (Governor’s Office, WVDHHR, WVDE, Payors and other Associations) to provide technical assistance in the facilitation of school/HCP/parent partnerships to improve year two participation in the initiative.  (Copy appended to Official Minutes, Attachment Q and addendum.)


X. Coordinated School Health Programs


Ms. Purkey provided a report regarding a Coordinated School Health Program (CSHP) model and existing efforts in West Virginia and nationally.  CSHP is an approach that brings together the resources of families, schools and communities to help students stay healthy and make the most of their educational opportunities.  



XI. Position Statement on Coordinated School Health


Mrs. Fish presented a position statement on coordinated school health for the Board’s consideration.  Upon motion by Ms. Haden, seconded by Mrs. Manchin, the Board unanimously approved the position statement on coordinated school health.  (Copy appended to Official Minutes, Attachment M.)


XII. Reports


Board Member/Committee Reports.  Mrs. Manchin, Dr. Johnson, Mrs. Fish, and Ms. Haden provided information regarding their participation in a number of meetings and events.  President Cook brought to the Board’s attention the need to move the March meeting date in order to accommodate members attending the NASBE legislative conference and committee meetings.  It was the consensus of the Board that the meeting be rescheduled as appropriate.


  Professional Development Study Group.  President Cook (distributed information), assisted by Dr. Karen K. Larry, Executive Assistant, State Superintendent’s Office, provided an update regarding a recent meeting of the Board’s Professional Development Study Group and presented a proposed professional development plan and goals for 2009-2010 for the Board’s consideration.  The plans and goals will be presented for action at the February meeting.  (Copy appended to Official Minutes, Attachment R.)


State Superintendent’s Report.  Superintendent Paine presented Department personnel actions (distributed addendum) for the Board’s information and provided updates in Hampshire, Lincoln, McDowell and Mingo Counties.  Upon motion by Ms. Phillips, seconded by Dr. Johnson, the Board unanimously accepted the Superintendent’s report.  (Copy appended to Official Minutes, Attachment Mc and addendum.)


Regional Education Service Agency (RESA) Report.  Mr. Elmer Pritt, Executive Director of RESA IV, provided an update regarding RESA IV activities and initiatives.


XIII. WVBE Personnel Matters


Upon motion by Dr. Johnson, seconded by Ms. Phillips, the Board unanimously approved the Board’s personnel items.  (Copy appended to Official Minutes, Attachment N.)

XIV. Board Items for Future Consideration


President Cook requested that items mentioned during the meeting and any others that members wish to be considered for placement on a future agenda be provided to Dr. Jack McClanahan, Deputy State Superintendent of Schools, as soon as possible.  (Copy appended to Official Minutes, Attachment O.)



XV. Future Meetings

The next regular meeting of the Board will be held February 11-12, 2009 in Charleston, West Virginia.  


XVI. Adjournment


Upon motion by Dr. Johnson, seconded by Ms. Phillips and unanimously carried, the Board adjourned at 12:08 p.m.
