I.

Call to Order



President Lowell E. Johnson called the meeting of the West Virginia Board of Education to order at 11:00 a.m. on May 1, 2006, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.



The following members were present: President Johnson, Vice President Delores W. Cook, Secretary Priscilla M. Haden, Robert W. Dunlevy (via telephone), Barbara N. Fish, Sheila M. Hamilton (via telephone), Burma Hatfield, Jenny N. Phillips (via telephone), Ronald B. Spencer (via telephone) and ex officio Steven L. Paine, State Superintendent of Schools. Members absent were ex officios James L. Skidmore, Chancellor, the West Virginia Council for Community and Technical College Education and Bruce C. Flack, Interim Chancellor, the West Virginia Higher Education Policy Commission.



II.

Delegations



Mr. Erwin L. Conrad, Esq., counsel for Ms. Carol Morgan, Executive Director, Regional Education Service Agency (RESA) I, addressed the Board.

III.

Approval of Agenda



Upon motion by Mrs. Cook, seconded by Ms. Haden, the Board unanimously approved the agenda.

IV.

Consideration of Disciplinary Action Against a

Regional Education Service Agency (RESA) Executive Director

and Possible Appointment of Interim Executive Director



President Johnson requested Ms. Morgan's preference as to how she wished the discussion of possible disciplinary action to be conducted. Ms. Morgan indicated that she wished the discussion to be conducted in open session.



Discussion ensued regarding the procedures utilized in the processing of RESA financial matters.



Mr. Joe Panetta, Executive Director, Office of School Finance, Superintendent's Office, provided information regarding established operating procedures for RESA financial matters.

Following discussion, Ms. Haden moved, and Ms. Hatfield seconded, that Ms. Morgan be suspended without pay for 90 days effective May 1, 2006. The motion was carried unanimously.



President Johnson requested Superintendent Paine's recommendation regarding the appointment of an interim executive director. Superintendent Paine recommended that Mr. William K. "Bill" Grizzell serve as interim executive director of RESA I for 90 days or until such time as Ms. Morgan returns to employment, retires, or until the search process for a new executive director is completed. Ms. Hatfield moved and Mrs. Cook seconded that Superintendent Paine's recommendation be accepted. The motion was carried unanimously.



V.

Future Meetings



The next meeting of the West Virginia Board of Education will be held May 11, 2006 in Hardy County, West Virginia.



VI.

Adjournment



Upon motion by Ms. Hatfield, seconded by Mrs. Cook and unanimously carried, the meeting adjourned at 12:30 p.m.
