MINUTES
WEST VIRGINIA BOARD OF EDUCATION

November 9, 2005
I.
President Lowell E. Johnson called the meeting of the West Virginia Board of Education to order at 12:30 p.m. on November 9, 2005, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia.
The following members were present: President Johnson, Vice President Delores W. Cook, Secretary Priscilla M. Haden, Barbara N. Fish, Burma Hatfield, Jenny N. Phillips and Ronald B. Spencer, and ex officios Steven L. Paine, State Superintendent of Schools, and James L. Skidmore, Chancellor, the West Virginia Council for Community and Technical College Education. Members absent were: Robert W. Dunlevy, Sheila M. Hamilton and ex officio Bruce C. Flack, Interim Chancellor, the West Virginia Higher Education Policy Commission.
II.
Upon motion Mr. Spencer, seconded by Ms. Hatfield, the Board unanimously approved the agenda.
III.
Dr. Kenna R. Seal, Director, Office of Education Performance Audits, distributed and presented the 2005 Report of Ratings for the Board's consideration. The State Board annually rates both schools and school systems on the results of information reviewed from the system of education performance audits.
Upon recommendation of Dr. Seal and a motion by Mrs. Cook, seconded by Ms. Phillips, the Board unanimously issued the schools and school systems the accreditation/approval status as shown in the November 2005 Book of Ratings. (Copy appended to Official Minutes, Attachment A.)
IV.
Dr. Seal reported that an announced on-site review was conducted at Nicholas County High
School in Nicholas County on October 12, 2005. The Office of Education Performance Audits conducted the review which was limited in scope to the standards relative to school and student performance and progress. The review also consisted of resource evaluation.
Upon recommendation of Dr. Seal and a motion by Mrs. Cook, seconded by Ms. Phillips, the Board unanimously granted Nicholas County High School the accreditation status listed in the individual school report and gave the school and county until the next accreditation cycle to correct any deficiencies reported. V.
Mr. Patrick Leggett, President, West Virginia School Counselors Association, Ms. Barbara Blackburn, President, American School Counselors Association, and Dr. Linda Maier, Board Member, West Virginia School Counselors Association, provided a presentation entitled "Win-Win for West Virginia Students." President Johnson called for a break at 1:45 p.m.

President Johnson called the meeting back to order at 1:55 p.m.
VIII.
Mr. Keith Butcher, Executive Director, and Mr. Larry Lamb, Coordinator, Office of Instructional Services, Division of Instructional and Student Services, provided a status report on the statewide effort to improve mathematics achievement. Greenbrier County Schools personnel, Mr. Charles Callison, Ms. Donna Ream and Mr. Jerry Pomeroy, distributed information and provided a presentation regarding Greenbrier County Schools' five-year mathematics plan. IX.
Dr. Lynn Boyer, Executive Director, and Ms. Vickie Mohnacky, Coordinator, Office of Special Education, Division of Instructional and Student Services, presented the Medicaid Reimbursement FY-05 Annual Report for the Board's information. The Department has implemented this reimbursement program through the county school districts and RESAs. (Copy appended to Official Minutes, Attachment E.)
X.
Dr. Boyer and Ms. Ghaski Browning, Coordinator, Office of Special Education, Division of Instructional and Student Services, presented the West Virginia Students with Disabilities in Out-of-State Facilities FY-05 report for the Board's information. In 1993, the Department of Health and Human Resources and the West Virginia Department of Education (WVDE) entered into an interagency agreement with the provision that the WVDE, Office of Special Education fund the special education costs of eligible students with disabilities in accordance with federal and state statutes and regulations using its Individuals with Disabilities Education Act Part B Discretionary money. Dr. Boyer presented proposed Policy 2520.16 for the Board's consideration. (Copy appended to Official Minutes of November 10, 2005 at Attachment G.)
XII.
Upon motion by Mrs. Cook, seconded by Ms. Haden, the Board unanimously moved into Executive Session at 3:08 p.m pursuant to W. Va. Code §6-9A-3 for a matter involving attorney-client privilege and W. Va. Code §6-9A-4(b)(2)(A) for a personnel matter.
XIII.
The Board returned from Executive Session at 4:05 p.m. at which time President Johnson announced that no action was taken and no decisions were made.
XIV.
The next regular meeting of the Board will be held November 10, 2005 in Charleston, West Virginia.
XV.
Upon motion by Ms. Phillips, seconded by Mrs. Cook and unanimously carried, the meeting adjourned at 4:09 p.m.
